False abuse charges can cause problems

As the holidays approach, so may the tensions with your soon-to-be ex. Holidays are stressful times, and it is common for couples, especially those who are separating, to argue more frequently. If your fights tend to be loud and passionate to begin with, your spouse may have be able to jeopardize your chances of a positive divorce.

It is true that some people are willing to take advantage of the safeguards in place that protect victims of domestic abuse. They do this by making false claims. Accusations that you were violent or abusive to your spouse can wreak havoc on your life.

The high cost of false allegations

When police receive a call involving allegations of domestic abuse, they are required to remove the alleged abuser from the home. Even if the accuser refuses to later testify, police have no choice but to take action. If police charge you with domestic violence, avoiding a conviction is your primary concern. A conviction for domestic violence can potentially have devastating consequences, including:

  • Loss of your job
  • Loss of future employment opportunities
  • Loss of custody of your children
  • Jail
  • Fines
  • Financial struggles

If a spouse claims you engaged in physical or emotional abuse, your future is in jeopardy. Taking action to protect your rights is critical, beginning with obtaining quality legal representation. In addition, you can do the following:

  • Avoid contact with your spouse
  • Stay off social media
  • Remain calm
  • Avoid any words or actions that can others can interpret as threatening

It is possible that your spouse will try to keep the children from you or contact your family about your arrest. Difficult as it may be, keeping your cool will benefit you.

Your attorney can advise you about the best way to respond to the accusations, but any negative behavior, such as engaging in public arguments or threatening emails, can only come back to harm you in a California court. The more restrained you are, the more likely you will be able to work toward a more positive resolution to the domestic violence charges against you.
