California man likely planning criminal defense following arrest

There is probably not a single driver in California who has not found him or herself drifting onto the shoulder of the road at one time or another. This occurs for a variety of reasons, including a slight miscalculation of a curb or moment of distraction. While usually a harmless incident, police claim that such an action recently led to two fatalities. The driver of the car that allegedly drifted onto the shoulder has since been arrested and may be considering his criminal defense options.

The incident occurred one evening in early April. According to reports, three male juveniles were walking on the shoulder of the road when two of them were allegedly struck by a pickup truck driven by a 62-year-old man who lives near the scene of the accident. One of the teenagers died at the scene while the other passed away at the hospital. The third teen was not injured.

Police at the scene claim that they determined that they man was under the influence of drugs. He now faces charges of vehicular manslaughter and driving under the influence. It is unclear what led California officers to suspect drug use or how their suspicions were confirmed.

The death of the two teenagers is a tragedy, and it is understandable that justice is sought in the case. Because of the age of the victims, it may be easy for the general public to forget that all people accused of a crime are presumed innocent until and unless proved otherwise, and that it is often difficult to meet the high burden of proof required to gain a conviction. Because of the seriousness of the accusations against him, the defendant may benefit from seeking the guidance of an experienced defense attorney to help decide and implement his criminal defense.
